A citizen or lawful permanent resident of the United States may file this form with the Immigration and Naturalization Service (INS) to establish the relationship to certain alien relatives who wish to immigrate to the United States. The petitioner must file a separate form for each eligible relative.

The U.S. Embassy in Georgetown will accept petitions for immediate relative immigrant classification (I-130s) from American citizens who are resident in Guyana and meet the necessary criteria. The Embassy will only accept such petitions if the petitioner can satisfy the residency requirement.
In order to demonstrate residency, the American Citizen petitioners must be able to show that they have permission to reside in Guyana and that they have been doing so continuously for at least six months before filing the petition. Individuals who are in the country on a temporary status, such as student or tourist, would not be considered to meet the residency standard.
The Embassy will also consider accepting petitions filed in Guyana for cases which constitute true emergencies. Examples of family emergency include minor children who would be unexpectedly left without a caretaker.
All Legal Permanent Residents, and American Citizens resident in the United States or with a permanent address in the United States must file I-130 petitions at the USCIS (United States Citizenship and Immigration Service) Center having jurisdiction over their place of residence (as indicated on the USCIS website: http://www.uscis.gov/files/form/i-130.pdf). Petitioners can obtain information on how to file an I-130 with USCIS in the United States on the USCIS website, www.uscis.gov, or by contacting the U.S. Embassy in Georgetown.
Finally, we would like to remind you that if you file the I-130 petition for your spouse in the U.S., you can file an I-129F petition simultaneously to apply for a K3 visa.
